Welcome to My Bump Hub. We are glad you are here. These Terms and Conditions (the "Terms") explain the rules for using mybumphub.com and the related pages, forms and services we offer, and any accounts, apps or features we add later (together, the "Hub"). Please read them carefully. Our Privacy Policy explains how we handle personal information and is part of these Terms.
1. Who we are
The Hub is operated by My Bump My Baby LLC, doing business as My Bump Hub ("My Bump Hub," "we," "us" or "our"). You can reach us at info@mybumphub.com or by mail at 290 Madison Ave, New York, NY 10017.
2. Accepting these Terms, and other terms that may apply
By using the Hub, creating an account, submitting a form or checking a box that refers to these Terms, you agree to these Terms. If you do not agree, please do not use the Hub. If you use the Hub on behalf of an organization, you confirm that you have authority to accept these Terms for that organization, and "you" includes that organization.
Depending on how you use the Hub, additional terms also apply to you:
- Clinical Partner Terms for licensed clinical providers who list on the Hub, including their annual partner plans.
- Village Partner Terms for other businesses, organizations and supporters who list on the Hub, including their annual partner plans.
- Ticketing terms. The Hub does not sell event tickets today. Ticketing terms will be posted before tickets go on sale, and they will apply to event organizers and ticket buyers.
These Terms apply together with any additional terms that apply to you. If they conflict, the additional terms control for that topic.
3. What the Hub is
My Bump Hub is a national online directory and community resource. It helps families find information about doulas, maternal health providers, organizations and other partners across the United States, it helps those providers and partners share information about themselves, and it shares information about community events.
The Hub is an information and technology service. In particular:
- We are not a health care provider. We do not provide medical, nursing, midwifery, doula, mental health, legal or other professional services.
- We are not a party to your arrangements. Any agreement, booking, payment or relationship between a family and a provider or partner is solely between them. We do not schedule, supervise, direct or pay for services, and we are not responsible for how any provider or partner performs. Events are run by their organizers, not by us, unless we clearly say we are the organizer.
- We do not make referrals. A listing is not a referral or a recommendation for your specific needs. It means the provider or partner completed our verification checks for their partner type as of our most recent check (see Section 5). An "ID verified" badge means only what Section 6 describes.
4. Not medical advice
Content on the Hub, including articles, videos, provider profiles, events and community posts, is for general information only. It is not medical advice and it is not a substitute for care from a qualified professional. Using the Hub does not create a provider and patient relationship, or any professional relationship, between you and My Bump Hub.
Every pregnancy, birth and postpartum experience is different. Please check with your provider before making decisions about your health or your baby's health. If you think you or your baby may be having an emergency, call 911 or go to the nearest emergency room right away. The Hub is not monitored for emergencies.
5. How we verify providers and partners
We verify providers and partners before we list them, and we re-check them periodically, at least annually. Our checks may include each provider's license, certifications and other credentials.
- Clinical Partners (licensed clinical providers): our checks may include their professional license with the state licensing board, their certifications with the issuing organization, their National Provider Identifier (NPI), professional liability insurance and government ID.
- Village Partners (businesses, organizations and supporters who are not licensed clinicians): our checks may include identity, business registration, insurance where relevant and references. If a Village Partner lists a license or certification, we check that too.
The checks for each partner type are described in the Clinical Partner Terms and the Village Partner Terms.
Here is what verification means, and its limits:
- It is a check at a point in time. We review documents and public registries as they stand when we check. A license, certification or insurance policy can lapse, be restricted or change after that. Providers and partners must tell us about changes, and we re-check periodically, at least annually, but there can be gaps between checks.
- It covers what we checked. Verification confirms that the specific items we checked were valid and in good standing in the records we reviewed. It does not cover everything a provider or partner says about themselves, such as their experience, approach, availability or prices.
- It is not a guarantee. Verification is not a promise about the quality of anyone's care, products or services, any health outcome, or whether a provider is the right fit for you. It is not medical advice.
- You still choose. Please make your own choices, ask questions, and check with your provider about whether a service is right for you. You can also confirm a license yourself with the state licensing board.
If you think a listing is inaccurate or a credential has lapsed, please tell us at info@mybumphub.com and we will look into it.
Where our checks include government-issued ID, we use Stripe Identity, as described in Section 6.
6. ID verification for village members
6.1 Who needs to verify. Everyone who enters the village must pass an ID check through Stripe Identity first. This applies to everyone, including families and supporters who sign up through Join the Village or our family and friends signups, doulas, Listed Parties, app and technology partners, product brands and other partners (each, a "Village Member"). For a business or organization, the person who manages the listing or account must verify, and we may ask others who act for it to verify too. No one gets access to the village until their ID check is complete. You do not need an ID check to browse the public pages of the Hub, but you do need one to join or enter the village.
6.2 When it happens. The ID check is your first step into the village. It is not part of our sign-up or payment forms. After you sign up, apply or pay, we email you a secure link to your ID check. We send your village access or login link only after Stripe confirms that your check is complete. Until then, your signup or application is pending, you do not have access to the village, your profile is not shown and your listing does not go live.
6.3 If you are not ready yet. That is fine. We will keep sending you reminders with your link until you complete your check. You can ask us to stop the reminders and close your signup at any time at info@mybumphub.com. You can pay for a partner plan before your ID check, but payment does not give access to the village, your listing or any Partner Tier features until your ID check and our other verification checks are complete. Your Partner Terms give you 30 days after you pay to complete verification, and if we cannot verify you, we refund your payment in full (Partner Terms Section 10.6). For paying partners, reminders continue until verification is complete or your payment is refunded.
6.4 Your responsibilities. You must be at least 18. Use only your own valid government-issued photo ID. Do not use someone else's ID or a fake or altered ID, and do not complete a check for someone else. Each person may hold one membership. If we believe a check was not genuine, we may suspend or remove your membership, account or listing.
6.5 Stripe's role. Stripe performs ID checks as our service provider. Stripe shows you its own notices and consent screens, and Stripe's terms and privacy policy apply to how Stripe handles your information. We, not Stripe, decide who joins the village. A check can fail for ordinary reasons, such as a blurry photo. If that happens, you can try again or ask us for another way to verify.
6.6 Selfies and alternatives. If your check includes a selfie, we ask for your written consent first. You can choose an ID check that does not use biometric information instead, as described in Section 3.6 of our Privacy Policy.
6.7 What "ID verified" means, and its limits. "ID verified" means the person completed an ID check through Stripe Identity, and the check confirmed a valid government-issued photo ID (and, if a selfie was used, that the person matched the photo) at the time of the check. That is all it means.
- Identity only. It does not check licenses, certifications, training, insurance or experience. Our credential checks for providers and partners are separate and are described in Section 5.
- Not a background check. It does not check criminal history, references or reviews, and it is not a consumer report. We do not use ID checks to decide anyone's eligibility for credit, insurance, housing or employment.
- Not a guarantee. It is not a promise about anyone's quality, safety, conduct or any health outcome. It is not an endorsement by us or by Stripe, and it is not medical advice.
- You still choose. Please make your own choices, ask questions, and check with your provider about whether a service is right for you.
6.8 Re-checks. We may ask you to verify again, for example if your ID expires, your information changes, we see signs of fraud, or the law requires it. If your verification lapses, if you ask us to delete it, or if we find a problem, we remove the ID verified badge and pause your access to the village until you verify again.
6.9 Privacy. Section 3 of our Privacy Policy explains what is collected in an ID check, how it is used, how long it is kept, and your choices.
7. Who can use the Hub
You must be at least 18 years old to use the Hub, submit a form, create a listing or use any paid feature, or to create an account if we offer accounts. The Hub is not directed to children under 13, and we do not knowingly collect personal information from them. When you share information about your baby, such as a birth date, you are sharing it as the baby's parent or caregiver, and we handle it as described in our Privacy Policy.
8. Accounts
No accounts today. The Hub does not offer user accounts or passwords today. If we offer accounts in the future, including any way to sign in with a third-party service such as Google, these terms will apply to them. Please give accurate information and keep it up to date.
Keeping an account secure. If we offer accounts, you will be responsible for keeping your login secure, including any third-party account and any device you use, and for activity under your account. Please do not share your login. If you think someone has used your account without permission, tell us right away at info@mybumphub.com. We may suspend or close an account to protect you, other users or the Hub, for example if we see signs of unauthorized access or a violation of these Terms.
Closing an account. You can ask us to close an account, or to delete your information, at any time by contacting info@mybumphub.com. If you are a partner, closing your account or removing your listing ends your partner plan at that time, as described in the Partner Terms. Once you are verified, partner plan payments are non-refundable, so there is no refund for the rest of your paid year. Partner plans follow the Partner Terms.
9. Using the Hub as a family member or supporter
Anyone can browse the public pages of the Hub, read public resources and learn about events without an ID check. Joining or entering the village is different: families, partners, friends and other supporters who sign up through Join the Village or our family and friends signups must pass an ID check first, and get access to the village only after their check is complete (see Section 6). Joining our app waitlist alone does not give village access and does not require an ID check. When you use the Hub you agree to:
- Give accurate information in any form you submit.
- Only share information about another person (for example, the person you are supporting) if you have their permission.
- Use what you find on the Hub for your own personal, non-commercial purposes.
- Make your own decisions, with your provider, about care and services.
10. Provider and partner listings
Doulas, maternal health providers, organizations, nonprofits, Doula Ambassador Circle members and other partners who submit a profile or application (each, a "Listed Party") must also accept the Clinical Partner Terms or the Village Partner Terms, whichever fits their work. Those terms cover verification, keeping credentials current, the license to publish profile content, paid partner plans and more. In short, every Listed Party agrees that everything they submit is true, current and not misleading, and that they are responsible for their own licenses, certifications, insurance and legal compliance. We may decline, suspend or remove any listing as described in those terms. You may ask us to remove your listing at any time by contacting info@mybumphub.com.
11. Electronic signatures
Some of our forms ask you to type your name as your signature. You agree that typing your name and submitting the form is your electronic signature, that it has the same effect as a handwritten signature, and that you intend to sign and be bound by the document you are submitting. You consent to doing business with us electronically and to receiving agreements, notices and records electronically, consistent with the federal Electronic Signatures in Global and National Commerce Act (E-SIGN) and applicable state electronic transaction laws. You can ask for a paper copy of any agreement you signed, or withdraw your consent to electronic records, by contacting info@mybumphub.com. Withdrawing consent may mean we cannot keep your listing or account active. You are responsible for having a device, internet access and an email account that let you receive and keep electronic records.
12. Purchases: partner plans and payments
- Partner plans. Clinical and Village Partner Tiers are annual plans. You pay upfront for one year, and your listing goes live after we verify you. Payment does not give access to the village, your listing or any Partner Tier features until your ID check through Stripe Identity is complete (see Section 6). If we cannot complete your verification, including because we do not receive the documents we need within 30 days after you pay, we refund your payment in full. Once you are verified, all partner plan payments are final and non-refundable, except where the law requires a refund or for our own billing mistakes. Plans paid through PayPal do not renew automatically: before your year ends, we email you with the price and a renewal deadline, and if you do not renew by the deadline, your plan ends at the end of your paid year. We will not charge you automatically unless you first agree to automatic renewal. Before you buy, we show you the price, how renewal works and these refund terms. Questions, or want to end your plan? Email info@mybumphub.com. After you buy, we email you a confirmation, and we confirm any changes by email. The full rules, including price locks and renewal alerts, are in the Clinical Partner Terms and Village Partner Terms.
- Event tickets. The Hub does not sell event tickets today. Ticketing terms will be posted before tickets go on sale.
- App plans. If we offer paid plans in the My Bump app, they will be covered by the terms shown when you buy.
- Payment processing. Payments are processed by our third-party payment processors (currently PayPal, with Stripe coming soon). Our payment processors receive your payment card or account details directly, and we do not receive or store your full card number. Each processor handles payment information under its own terms and privacy policy.
- Prices and taxes. Prices are in U.S. dollars. You are responsible for any applicable taxes, which will be shown at checkout where they apply.
- No guarantee of results. Paid features may add visibility or tools, but we do not guarantee any particular results, such as clicks, leads, bookings or revenue.
13. Acceptable use
You agree not to:
- Post anything false, misleading, defamatory, harassing, hateful, sexually explicit or threatening.
- Impersonate anyone or misrepresent your credentials or affiliations.
- Create fake, duplicate or automated accounts, or join the village for anyone other than yourself.
- Use someone else's ID or a fake or altered ID, or try to get around our ID checks.
- Give medical diagnoses or make guarantees about health outcomes through the Hub.
- Post anyone else's personal or health information without their permission.
- Send spam, collect other users' information, or use listings to contact people for purposes unrelated to the services listed.
- Scrape, copy or harvest the directory, or use bots or automated tools, without our written permission.
- Interfere with, hack, probe or overload the Hub, try to get into another person's account, or get around any security feature.
- Upload viruses or harmful code.
- Use the Hub in a way that breaks any law or infringes anyone's rights.
We may suspend or end your access to the Hub if we believe you have broken these rules.
14. Content you submit
"User Content" means anything you submit to the Hub, including form responses, profile content, event listings, messages, comments and videos. You keep ownership of your User Content. Besides any license in the Partner Terms, you give us a non-exclusive, royalty-free license to use, store, copy and process your User Content to operate, improve and promote the Hub and to respond to you. You are responsible for your User Content. If you send us ideas or feedback, we may use them without any obligation to you.
If you believe content on the Hub infringes your copyright, please contact us at info@mybumphub.com with enough detail for us to find and review it.
15. Our intellectual property
The Hub, including its design, text, graphics, logos, the My Bump Hub name and the way the directory is organized, belongs to My Bump Hub or our licensors and is protected by law. You may view and use the Hub for its intended purpose only. You may not copy, sell, modify or reuse it without our written permission.
16. Third-party links, embeds and services
The Hub includes links to provider and partner websites, embedded videos (for example, from YouTube), forms hosted by others (for example, Google Forms), payment services (currently PayPal) and identity verification services (Stripe Identity). Some outbound links include tracking tags (UTM parameters) so we and our partners can see that a visit came from the Hub. Third-party sites and services have their own terms and privacy policies, which we do not control. We are not responsible for their content, products, services or practices. Your use of them is at your own risk.
17. Communications
By giving us your email address and checking a box consenting to communications, you agree that we may email you about the Hub, your listing, your application, your signup and related updates. You can unsubscribe from marketing emails at any time using the link in the email. We may still send you messages about your listing, application or purchases.
We do not send automated text messages today. If we offer text messages in the future, we will ask for your separate, express consent first, and that consent will never be a condition of buying anything. Message and data rates may apply, and you will be able to reply STOP to opt out or HELP for help.
18. Disclaimers
THE HUB AND ALL CONTENT, LISTINGS, EVENTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, MY BUMP HUB DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY. WE DO NOT PROMISE THAT THE HUB WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ANY LISTING IS COMPLETE OR CURRENT. OUR VERIFICATION IS LIMITED TO THE CHECKS DESCRIBED IN SECTION 5, AS OF THE DATE WE MADE THEM. AN ID CHECK CONFIRMS IDENTITY ONLY, AS DESCRIBED IN SECTION 6, AS OF THE DATE OF THE CHECK. WE MAKE NO PROMISES ABOUT THE QUALITY OF ANY PROVIDER, PARTNER OR EVENT, OR ABOUT ANY HEALTH OUTCOME.
19. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, MY BUMP HUB AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL, ARISING FROM OR RELATED TO THE HUB, ANY LISTING, ANY EVENT, OR ANY SERVICES OR DEALINGS BETWEEN YOU AND A PROVIDER, PARTNER OR ORGANIZER, EVEN IF WE WERE TOLD THESE DAMAGES WERE POSSIBLE.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE HUB IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) $100.
Some states do not allow certain limits on warranties or liability, so some of these limits may not apply to you.
20. Indemnity
You agree to defend, indemnify and hold harmless My Bump Hub and its owners, officers, employees, contractors and agents from any claims, losses, damages and expenses (including reasonable attorneys' fees) arising from your User Content, your use of the Hub, your violation of these Terms or the law, or, if you are a Listed Party or an event organizer, the services you provide, the events you run and your dealings with families and attendees.
21. Dispute resolution and governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict of law rules.
Any dispute arising from these Terms or the Hub will be resolved only in the state or federal courts located in New York County, New York, and you and we consent to the jurisdiction of those courts. Either of us may bring a qualifying claim in small claims court.
Before starting any formal dispute, you agree to contact us at info@mybumphub.com and give us 30 days to try to resolve it informally.
22. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date above, and for important changes we will give notice, such as by email or a notice on the Hub, before they take effect. Changes will not apply to disputes that arose before the change. If you keep using the Hub after changes take effect, you accept the updated Terms. Changes to paid partner plans follow the notice rules in the Partner Terms.
23. Other important terms
- Ending your use. You may stop using the Hub at any time. We may suspend or end access to the Hub, an account or any listing at any time. Sections that by their nature should continue (such as licenses already granted for published materials, disclaimers, limits of liability, indemnity and dispute resolution) continue after your use ends.
- Entire agreement. These Terms, our Privacy Policy, any additional terms that apply to you (Section 2) and any terms shown at checkout are the full agreement between you and us about the Hub.
- Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
- No waiver. If we do not enforce a part of these Terms, that does not mean we give up the right to do so later.
- Assignment. You may not transfer these Terms without our permission. We may transfer them, for example to a successor company or a new entity that operates the Hub. Once My Bump Hub, Inc. is formed, we may assign these Terms to My Bump Hub, Inc. or another affiliate.
- Independent parties. Nothing in these Terms creates a partnership, joint venture, employment or agency relationship between you and us, or between us and any Listed Party or organizer.
